          *  We don’t live in a vacuum of history.  You don’t have to be a lawyer to learn the history of the courts, and how the other branches of government have interacted in the past.  Take the time, if you will, to read the cases on this website.  If you don’t like the analysis there, look up and read the cases for yourself.  For example, how many of you know that the case of Roe v. Wade, legalizing abortion, ruled that:

For the stage subsequent to viability, the State in promoting its interest in the potentiality of human life may, if it chooses, regulate, and even proscribe, abortion except where it is necessary, in appropriate medical judgment, for the preservation of the life or health of the mother.”

Simply put, that means that even in Roe v. Wade, the court said that abortion can be prohibited by government in the third trimester.  Were you ever taught that?  Have you wondered how we got from there to the recent federal court decision striking down the partial-birth abortion ban in 31 short years?

Use your favorite search engine and look for the term “independent judiciary” or “independence of the judiciary” and read the philosophies and affiliations of those standing behind the courts, including the ABA.  Do a search of the words “activist judges” and see how few powerful organizations are doing anything about it.
