Listen
to excerpts from the audiobook version of CourtZero: A Guide to Judicial
Activism for Revolutionaries and Regular Folks:
Chapter 1: CourtZero.
What the book is all about. We talk about the five steps between freedom
and oligarchy.
Chapter 5: Ed, Larry, and
Jerry. This chapter is a fun exploration of what “separation of
powers” really means. This is great for students and anyone who is
curious about how the three branches of our government are functioning.
Chapter 7: A Living,
Breathing Constitution. This is about why an evolving Constitution is
both a myth and very dangerous.
CourtZero on the radio
Here is a
great interview, for free download, between Marquis Washington of Dividing
Lines Magazine and CourtZero’s Craig McCarthy. Click here to
download the entire wide-ranging and engaging discussion of activist judges and
activist groups like the ACLU. If you’d rather hear the
forty-minute long and commercial-free interview one segment at a time, use the
links below.
Segment one explores the
questions “what is judicial activism”, and “what’s the
deal with the ACLU?”
In part two, we discuss
whether the judicial branch is corrupt or simply malfunctioning, along with
impeachment of judges, general misunderstanding of what “the law”
truly is, and what motivates activist judges.
Part three covers legal
efforts to separate people of faith from public life, as well as federal law 42
USC section 1988 and how taxpayer money is used to sue those same taxpayers
over public religious displays.
In segment four, Marquis and
Craig discuss what people concerned about judicial activism can do, and talk
about why the ACLU is scarier than the Patriot Act could ever be.
Craig
McCarthy of CourtZero was for a time a regular contributor to, and legal
correspondent for, Free Market News,
a libertarian website (slogan: private solutions to public
problems). Free Market News Network radio has interviewed Craig several
times. You can download some samples:
In the first
interview, host John St. George discusses the arrest of Christian street
preachers at the 2004 Philadelphia OutFest event, for exercising what the
authorities considered unfavorable speech. We also talk about why a
“living, breathing” Constitution means no Constitution at all, and
some other issues.
The next free downloadable interview
includes an in-depth update on the arrested Christians in Philadelphia and goes
on to discuss the historic and heartbreaking cases of Terri Schiavo and the
infant Sun Hudson, as well as euthanasia in general.
DO
NOT GET A LIVING WILL, an article written after the Schiavo tragedy, has
gotten a good amount of attention among bloggers and internet
users. The third
interview deals with the controversial notion that you should not get a
living will right now, despite popular opinion to the contrary, since they tend
to operate as nothing less than a permission slip for doctors to stop treating
you.
The Supreme Court has ruled on whether or not California or other states can
allow their citizens to be treated with doctor-prescribed and regulated
marijuana. No matter where you come down on such use of marijuana for
medical purposes, the implications for the amount of power the Court grants the
federal government over local governments is important, and this interview
points out that there are no longer any limits to the power of the Commerce
Clause. Click here to listen.
For a while everyone devoted way too much time to talking about Jennifer
Wilbanks, the “runaway bride.” While it seems to be a
frivolous story on its face, there are serious issues in there somewhere.
In this interview, Craig talks
about the implications of using the legal system to punish people for
exercising basic freedoms.
Eminent
Domain. Kelo v. New London changes everything. In this interview we wonder aloud
whether or not our Constitution exists anymore at all. If property rights
mean nothing in the face of the judge’s rulings, then what real rights
are there?
CourtZero fun stuff
Recently three justices of the
United States Supreme Court were interviewed about themselves, the role of
foreign law in interpreting the US Constitution, and whether or not they expect
regular folks to even care about what the court is doing. Click here to hear the
audio of the most interesting remarks of the justices along with visual
comments from CourtZero.
Here is a bit of satire.
This radio commercial is a parody of the ACLU’s
“It’s American” attack on the Patriot Act. In the CourtZero version, we se
how destructive and unsettling the ACLU’s efforts are to regular people.
